Welcome to Inspector's Compass — your quick guide to PACE Code C and the rules on cautions for the 2026 Inspectors' Legal Examination. A caution must be given whenever there are grounds to suspect a person of committing an offence, before any interview under caution begins. The wording is fixed by law: You do not have to say anything, but it may harm your defence if you fail to mention something relevant, and anything you say may be used in evidence. There are exceptions — urgent interviews under Annex C, imminent risk to life, evidence or other people, allow action first, caution can wait. Remember silence has consequences: adverse inference under Section 34 only applies if the caution was properly given before questioning. For the exam, use the memory cue: no caution, no adverse inference — a golden rule examiners love to test.
